At Nelsons, we are committed to protecting everyone's personal data.
This Recruitment Privacy Notice (“Notice”) provides information about Nelsons’ processing of your personal data as part of this process. It applies, for example, to individuals who apply for a job or register with a talent community, attend a recruitment event, undertake an assessment with Nelsons or participate in other recruitment processes (“applicants”).
The purpose of this notice is to provide you with additional information about what personal data we process and for what reasons, and the privacy principles we follow, as well as to inform you of your rights in relation thereto.
Any personal data communicated to or collected by Nelsons is controlled by Nelsons. It is therefore up to us to decide how we hold and use your personal information, and to ensure that we comply with data protection laws when processing it.
For the purposes of this notice, “Nelsons” means A Nelson & Co Limited and each of its subsidiaries and affiliates.
1 COLLECTION OF YOUR PERSONAL DATA
Personal data collected directly from you
In the context of recruitment and your application for a position at Nelsons, we collect personal data about you in order to progress your application for employment at Nelsons (including your name, email address, telephone number, address, academic and professional qualifications and experience, etc.). You may choose to import information about yourself from other websites (for example, LinkedIn).
Special categories of personal data
As part of your application, you may provide sensitive personal data, often called special categories of personal data (for example, information relating to your race or ethnicity, political opinions, religious beliefs, trade union membership, criminal record, physical or mental health, biometric information or sexual orientation). If you provide sensitive personal data, you do so voluntarily and agree to it being used as described in this notice.
We only process these special categories of personal data in specific circumstances and in accordance with applicable privacy legislation.
Personal data collected from third parties
We may also collect personal data from third parties through referrals, recruitment agencies, background check service providers, etc.
2 PROCESSING OF YOUR PERSONAL DATA
We may use the personal data we collect or obtain about you for screening, assessment and interview purposes:
- Profile management: We may process personal data to manage your profile in our recruitment systems in order to provide you with current and future job offers, tailoring the content we provide to you based on your skills, interests, location, etc.
- Pre-screening: We check that you can legally enter into a contract and that you meet the essential criteria for the position, i.e. you have the appropriate work authorization and have answered the position-specific screening questions.
- Profile review and evaluation.
- Personal interview: When you are invited for a face-to-face or video conference interview (e.g. Microsoft Teams), the examiner may ask you relevant questions to assess your suitability for the position.
- Communication: We may contact you by email to answer any recruiting questions, send communications, and schedule interviews.
We do not use profiling (when an electronic system uses personal information to try to predict something about you) or automated decision-making (when an electronic system uses personal information to make a decision about you without human intervention).
3 DATA RETENTION
We will retain your personal data for as long as necessary for the purposes for which it was collected (including in accordance with applicable law or regulation).
If your application is unsuccessful, Nelsons may retain and use the information you provide to us for twelve (12) months from the recruitment decision to address any matters relating to your application, to contact you about other employment opportunities and for Nelsons' legitimate business purposes.
When personal data is no longer necessary or relevant for the purposes we have defined, or when you have indicated that you no longer wish to remain in contact with us, we securely destroy it.
4 PERSONAL DATA AND PLACE OF PROCESSING
We may share your personal data for recruitment-related purposes, subject to and in accordance with applicable laws and requirements:
- other Nelsons group companies, including those which may be based outside your place of residence and/or the EEA/UK;
- approved independent agents, service providers and/or contractors of Nelsons and approved third parties who perform reference and background checks on behalf of Nelsons; And
- competent public authorities, government, regulatory or tax agencies, to comply with a legal obligation.
International data transfers
We may transfer personal data internationally. If personal data is transferred overseas, Nelsons ensures that it is afforded a level of protection similar to that required by law in the country of origin and that the transaction is carried out in accordance with any applicable data localization or transfer requirements.
If you are located in the EEA or the UK, please be aware that as an international group of companies, we transfer personal data outside of the EEA or the UK.
Nelsons will ensure that it is protected in the same way as if it were used in the EEA and, where appropriate, will put in place a contract with the third party in a country which requires it to protect personal data to the same standards as those in the EEA/UK.
5 WHAT ARE YOUR RIGHTS?
When we process your personal data, you have a number of rights regarding how it is processed. You can exercise these rights at any time. Below is an overview of these rights, along with an explanation of what they mean for you.
You have the right:
- to be informed of the collection and use of your personal data. You have the right to receive clear, transparent and easy-to-understand information about how we use your personal data and the rights you have in this context. This is why we are providing this information to you as part of this notice;
- to request a copy of the personal data we hold about you;
- to request that we update the personal data we hold about you or correct any that you consider to be incorrect or incomplete;
- to request that we delete the personal data we hold about you or restrict the way we use it;
- to request that we limit our processing or object to the processing of your personal data;
- withdraw your consent to the processing of your personal data (to the extent it is based exclusively on consent); And
- file a complaint with a data protection authority in your country.
Exercise of your rights
To exercise your data protection rights, you can contact the personnel team or write to dataprotectionofficer@nelsons.net.
Submit your application for a currently available position only through appropriate channels (for example, on Nelsons job boards). If your request is addressed to the correct point of contact, it will be processed more quickly.
